Please read these terms carefully before using our platform. By accessing or using HANUMA VARAHI ESTATES, you agree to be bound by these terms and conditions.

Introduction

Section 1

This website HANUMA VARAHI ESTATES.com, including any subdomains thereof, and any other websites through which its services are made available, our mobile, tablet and other smart device applications, and application program interfaces (hereinafter collectively referred to as "HANUMA VARAHI ESTATES") is owned, hosted and operated by Info Edge (India) Ltd (hereinafter referred to as IEIL), a company incorporated in India under the Companies Act, 1956 and having its registered office at 11-672, Gnanamma Thota Metlarevu Santhapeta Nellore, 524001.

These terms and conditions, privacy policy and community guidelines regulating use of these Services constitute a legally binding agreement. HANUMA VARAHI ESTATES and/or any other website(s) linked to this website is an online information and communications service provided to you, subject to your compliance with the terms and conditions set forth below.

We may amend/modify these terms and conditions at any time, and such modifications shall be effective immediately upon posting of the modified terms and conditions on HANUMA VARAHI ESTATES. You may review the modified terms and conditions periodically to be aware of such modifications and your continued access or use of HANUMA VARAHI ESTATES shall be deemed conclusive proof of your acceptance of these terms and conditions, as amended/modified from time to time.

Definitions

Section 2

Service/Services

Includes the interactive online information service offered by HANUMA VARAHI ESTATES through which users may access information in our database, search tools, and advertising space such as listings and banners. The Service does not extend to HANUMA VARAHI ESTATES acting as an agent on behalf of any User/Customer.

Subscriber/User

Any person (individual or legal entity) who has subscribed to the Services of HANUMA VARAHI ESTATES (whether on a paid or free basis), with access restricted by a sign-in username and password.

Browser/Visitor

A person who utilizes any Services offered by HANUMA VARAHI ESTATES without creating an account (i.e., visits non-restricted portions).

Advertiser

A Subscriber/User uploading or relaying content using the Services.

RERDA

The Real Estate (Regulation and Development) Act, 2016 as amended, read with any rules or regulations framed thereunder.

Submission and Administration of Listings/Advertisements

Section 3

No guarantees are made by HANUMA VARAHI ESTATES or the providers of the AV content as to its accuracy or completeness. The User agrees to the use of any content or information provided to Company/HANUMA VARAHI ESTATES for promotional, marketing, and publicity purposes without any compensation.

Where you provide us with voice samples or voice recordings to generate voiceovers for video listings, you provide us with a royalty-free, irrevocable, worldwide, sublicensable, and transferable right and licence to use, modify, and further develop the voice samples and voice recordings.

RERDA Compliance:

  • Users covered under RERDA must obtain all requisite approvals, licenses and permits
  • Must disclose all material information as required by law
  • Must disclose registration details under RERDA
  • Must disclose whether property is free from encumbrances
  • Must furnish brief background regarding title, ownership and possession

The Company may require Users to support claims with documents and may require an affidavit stating the authenticity of information provided. The Company may, at its sole discretion, search for and remove properties submitted in violation of these provisions.

User Agreements:

  • All Properties and associated information provided will be accurate
  • Will not permit posting under a name other than a duly authorized real estate agent
  • Allow property listings to be searched, displayed, accessed, downloaded, and copied by users
  • Company has sole authority to choose the manner of display and searchability

Important Notice for Buyers/Renters:

Users buying/renting properties must verify details, rights, title, ownership, liens etc. on their own. The 'verified' tag on properties merely indicates verification of the property's existence as advertised, NOT verification of documentation, ownership details, area or pricing details.

Content Moderation

Section 4

We employ proprietary and third-party AI tools to identify and address harmful content on our platform. These tools are designed to take reasonable efforts towards detecting violations of platform terms and applicable laws, including harmful behavior such as speech that violates our platform terms.

Automated moderation may operate automatically or with human oversight, depending on the complexity of the content and internal guidelines. Based on the output of technological moderation, content may be approved, rejected, or escalated to a second level of review by human moderators.

Users have the right to raise grievances or appeal moderation decisions in accordance with our platform terms, and such feedback will be reviewed in accordance with established timelines, including by human moderators where necessary.

Note: While we endeavor to maintain accuracy and fairness, no system is perfect. These measures are implemented on an "as is" basis, and we will continue to refine them in collaboration with external service providers.

Payment Terms

Section 5

Payment Policy:

  • Payments for Services are on a 100% advance basis
  • Payment once subscribed is not refundable and any amount paid shall stand appropriated
  • No guarantees for accuracy or timeliness of refunds reaching User accounts
  • Company may set off amounts against any other payables

Security Measures:

Company uses maximum care to ensure that all data/information regarding electronic money transfer does not fall into wrong hands. For online transactions, users are directed to a Payment Gateway. Company does not store or keep credit card data.

Since transactions happen on a third-party network not controlled by Company, once a credit card transaction has been completed, the payment information is not accessible to anyone at Company after completion of the online transaction at the Payment Gateway.

Liability Disclaimer:

Company shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of information concerning the user's account and/or information relating to online transactions using credit cards/debit cards and/or their verification process.

Refund in Failed Transactions:

Though Company payment reconciliation team works 24×7, Company offers no guarantees for accuracy or timeliness of refunds reaching Subscribers' card/bank accounts due to multiplicity of organizations involved in processing online transactions. Refunds for wrong/objectionable property content would be at the discretion of HANUMA VARAHI ESTATES.

CPL Marketing Campaigns

Section 6

For Developers and Agents/Brokers:

  • Company shall endeavor to deliver agreed number of leads at agreed cost per lead
  • Company reserves right to decide and deploy the channel/product for advertising to generate leads
  • Company reserves right to stop any campaign on completion of obligation or upon non-receipt of payment
  • Company neither guarantees nor participates in potential conversion of delivered leads
  • Company is an intermediary under IT Act 2000. A lead is contact details of a user who has consented to be contacted
  • Any advance or amount received is non-refundable
  • Customer must strictly adhere to applicable data privacy law
  • Company shall not be liable for any loss, direct or indirect
  • Customer is responsible for protection of personal data as per applicable law

Video Community Guidelines

Section 7

User agrees to comply with the following when submitting video content:

  • Video should be original, free from any copyright issues
  • Video should not contain any personally identifiable information of the User/Agency
  • Video content should not be obscene/inappropriate
  • Video should not contain language detrimental to any community/segment

Video Content Screening:

Videos shared by users shall go through multiple stages of screening (human and technology driven) before going live. In case of violations, video content shall be removed from the listing.

Agents shall have the option to edit or remove videos during the course of the listing duration.

HANUMA VARAHI ESTATES shall utilize 3rd party services such as YouTube for hosting and streaming. Users must be compliant with YouTube Terms of Service and YouTube API Services - Developer Policies.

Use of Information

Section 8

User agrees to treat all information obtained from the Service, including listings, member directory, and any information otherwise made available ("Content") as proprietary to HANUMA VARAHI ESTATES.

Confidentiality Requirements:

  • Content reserved for members must be maintained as confidential and protected as a trade secret
  • HANUMA VARAHI ESTATES does not ensure accuracy of, endorse or recommend any Content
  • User uses Content at their own risk
  • Access listings solely for initial information and evaluation
  • Limit access and use to personal and internal use only

Prohibited Uses:

  • Do not use or reproduce Content for any other listing/advertising service
  • Do not use for further distribution, publication, public display, or preparation of derivative works
  • Users searching the Service in an abusive or excessive manner, by automated or manual means, shall be subject to immediate termination

Intellectual Property Rights

Section 9

All logos, brands, trademarks and service marks appearing in HANUMA VARAHI ESTATES are properties either owned or used under license by IEIL and/or its associates. All rights accruing from the same, statutory or otherwise, wholly vest with Company/its associates.

Important Notice:

Access to HANUMA VARAHI ESTATES does not confer upon the User any license or right to use these Marks. Use of these Marks in any form or manner is strictly prohibited. Any violation would constitute an offence under the prevailing laws of India.

Company respects the Intellectual Property Rights of all and has and will continue to adhere to all applicable laws. Company shall protect and respect the Intellectual Property Rights of users as well as third parties.

In a case where User(s) are found to be using HANUMA VARAHI ESTATES as a platform to infringe the Intellectual Property Rights of others, Company will be free to terminate this Agreement forthwith without any notice.

By allowing Users to access HANUMA VARAHI ESTATES, Company grants Users a limited, non-exclusive, non-assignable, revocable license to access and use the Services, provided that the User is in compliance with the terms and conditions.

Restrictions/Prohibitions

Section 10

The following actions constitute misuse and are strictly prohibited:

a) Impairment of Services

Utilizing Services in any manner that impairs the interests and functioning of Company/HANUMA VARAHI ESTATES or is non-compliant with laws including RERDA.

b) Unauthorized Use of Content

Copying, extracting, downloading, sharing, modifying, selling, storing, distributing, or making derivative works from any content, data, information, profiles, personal details, photographs and/or graphics available on HANUMA VARAHI ESTATES.

Users are expressly prohibited from:

  • Any commercial purposes such as creating alternate databases
  • Extending access to third parties without prior written consent
  • Undertaking business activity in competition with Company
  • Sharing access with persons not contracted with Company
  • Reselling products/services offered by Company

c) Automated Access & Scraping

Using or attempting to use any automated program, software, system (including spiders, robots, crawlers) to access, navigate, search, copy, monitor, download, scrape, crawl or extract data or content.

d) Unauthorized Access

Gaining or attempting to gain unauthorized access (by hacking, password mining, or any other means) to any portion of HANUMA VARAHI ESTATES, servers, websites, programs or computer systems.

e) Service Modification

Modifying services provided through HANUMA VARAHI ESTATES or their appearance using any technology or overlaying any additional offering without explicit written consent.

f) Security Breaches

Attempting to breach or breaching any security or authentication measures, probing, scanning or testing vulnerability of Company systems or networks.

g) Reverse Engineering

Reverse engineering, decompiling, disassembling, deciphering or deriving source code for the Site/Application or any related technology.

h) Circumvention

Bypassing or circumventing service limits including Search limits, Captcha limits, and technological protections used to protect content and exclude robots/spiders.

i) Interference & Disruption

Interfering with or disrupting the use of HANUMA VARAHI ESTATES or any computer networks connected to it.

j) Impersonation & Misrepresentation

Impersonating any other person or entity, making misrepresentations, forging headers or manipulating identifiers to disguise origin of information.

k) Harassment & Threats

Stalking, threatening, or in any manner harassing any other User.

l) Infrastructure Abuse

Imposing unreasonable or disproportionately large load on HANUMA VARAHI ESTATES' infrastructure.

m) Framing & Mirroring

Engaging in "framing," "mirroring," or simulating the appearance or function of HANUMA VARAHI ESTATES without prior permission.

n) Spamming

Spamming HANUMA VARAHI ESTATES or any Users including uploading, posting, emailing, transmitting unsolicited bulk or commercial communications.

Prohibited Content:

Hosting, uploading, posting, transmitting, or distributing any material or information that:

  • Violates any applicable law, statute, ordinance, rule or regulation
  • Belongs to another person to which you have no right
  • Infringes any copyright, trademark, patent, privacy or publicity rights
  • Contains computer viruses or malicious code
  • Is grossly harmful, harassing, invasive of privacy, hateful, disparaging
  • Relates to or encourages money laundering or gambling
  • Is harmful, threatening, abusive, harassing, libelous, vulgar, pornographic, paedophilic, obscene, or racially/ethnically offensive
  • Promotes enmity between groups on grounds of religion or caste with intent to incite violence
  • Constitutes or encourages conduct that would constitute a criminal offence
  • Deceives or misleads about origin of messages or communicates misinformation
  • Harms minors in any way
  • Threatens unity, integrity, defence, security or sovereignty of India

You expressly agree not to:

  • Copy and distribute information on any other server or modify/re-use information
  • Reproduce any part for commercial gain or incorporate in any other work or website
  • Remove any copyright, trademark or other intellectual property notices
  • Link to HANUMA VARAHI ESTATES without express written consent

Violations of system or network security may result in civil or criminal liability.

Disclaimer and Warranties

Section 11

Intermediary Status:

HANUMA VARAHI ESTATES is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000.

Service Provided "AS IS" and "AS AVAILABLE"

THE CONTENT OF HANUMA VARAHI ESTATES IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Company and third parties providing materials, services or content to this website, disclaim all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement of third party rights
  • Completeness or accuracy of information
  • Update or correctness of information
  • Freedom from computer viruses

Views expressed by Users are their own. Company does not endorse them and shall not be responsible for them.

No claim as to accuracy and correctness of information on the site is made although every attempt is made to ensure content is not misleading/offensive/inappropriate.

It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, Services, real estate and other related information listed on the website.

Company does not warrant that access to website will be uninterrupted or error-free or that defects will be corrected.

No Response Guarantee:

IEIL offers no guarantee or warranties that there would be satisfactory response or any response at all, once the listing/banner is put on display. Any payments made are solely for display of the property advertised.

Pre-Launch Offers Warning:

Users are strongly advised to independently verify the authenticity of any Pre-Launch offers. Company does not endorse investment in projects which have not received official sanction and have not been launched by the Builder/Promoter. Users dealing in such projects shall be doing so entirely at their risk and responsibility.

No information contained herein shall constitute an invitation or offer to invest in Company or any of its Affiliates. Nothing should be construed as a recommendation to use any product, process, equipment or formulation in conflict with any patent.

Geographical Limitations:

HANUMA VARAHI ESTATES is controlled and operated from India. If you use it from outside India, you are entirely responsible for compliance with all applicable local laws as well as international conventions and treaties.

Services offered in one region may differ from those in other regions due to availability, local/regional laws or other factors. Company does not make any warranty that a User in one region may obtain Services as provided in another region.

Limitation of Liability

Section 12

Limited Liability

Company will not be liable for any damages of any kind arising out of or relating to the use or the inability to use HANUMA VARAHI ESTATES, its content or links, including but not limited to:

  • Damages caused by errors, omissions, interruptions, defects, delays in operation or transmission
  • Computer virus, line failure
  • All direct, indirect, special, incidental, punitive damages
  • Loss of profit, exemplary or consequential damages
  • Damages based on warranty, contract, tort or any other legal theory including Force Majeure

Company assumes no responsibility for:

  • Any error, omission, interruption, deletion, defect, delay in operation or transmission
  • Communication line failure
  • Theft or destruction or unauthorized access to or alteration of User's data/information
  • Any problem or technical malfunction of online systems, servers, providers, computer equipment, software
  • Failure of email or players on account of technical problems or traffic congestion
  • Injury or damage to any User's or Member's or any other person's computer

Consumer Protection Act, 2019:

For purposes of the Consumer Protection Act, 2019, the term Consumer will be limited to paid Customers who have not subscribed for purposes of commercial gain (business purposes) and their intent to utilize services for individual use only.

Unless otherwise specified, the performance obligation of Company (service provider) is to provide access of its online portal to the customer for the duration of the subscription period. Reference to any usage, by whatever name called, is to provide the upper limit for consumption, which by itself does not create any additional performance obligation upon Company.

Privacy & Confidentiality:

Company will not be liable on account of any inaccuracy of information on this website. Any breach of privacy or of the information provided by the consumer to Company to be placed on the website by technical or any other means is not the responsibility of Company. Company does not guarantee confidentiality of information provided to it by any person acquiring/using all/any information displayed on HANUMA VARAHI ESTATES website.

Termination

Section 13

Company may, without notice in its sole discretion, and at any time, terminate or restrict your use or access to HANUMA VARAHI ESTATES (or any part thereof) for any reason, including, without limitation, that Company based on its judgement and perception believes you have violated or acted inconsistently with the letter or spirit of these terms and conditions or any applicable law.

Important:

If you utilize HANUMA VARAHI ESTATES in a manner inconsistent with these terms and conditions, Company may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse may be deemed to be fit and proper.

Indemnification

Submissions and unauthorized use of any information(s)/materials contained on HANUMA VARAHI ESTATES may violate copyright laws, trademark laws, the laws of privacy and publicity, certain communications statutes and regulations and other applicable laws, statutes, rules and regulations.

You alone are responsible for your actions or the actions of any person using your user name and/or password.

Indemnification Obligation:

You agree to defend, indemnify, and hold harmless Company and/or its associates, subsidiaries, their officers, directors, employees, affiliates, licensees, business partners and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from:

  • Your use of HANUMA VARAHI ESTATES material
  • Your breach of these terms and conditions
  • Your breach of any applicable law

Company will not be party to any legal proceedings between parties contracted through these Services. In case Company is sought to be implicated in any legal proceedings, costs will be recovered from the party that names Company as a party to such proceedings. Company shall abide with any court order served on it through due process.

Privacy Policy

Section 15

The Privacy policy of the Platform explains how we may use your personal data. We will at all times respect and ensure adherence to the Privacy policy. Additionally, various settings are provided to help you control the manner in which others may view your information as displayed on your profile and how you may be contacted.

Any feedback provided by a User shall be deemed as non-confidential to the user.

Terms of Use for Users

Section 16

Authorization & Consent:

When you indicate your interest in a Real Estate Listing or express interest in related services on HANUMA VARAHI ESTATES, you authorize HANUMA VARAHI ESTATES to contact you (even though you may have registered with NDNC/DNC), and you are sending your profile consisting of your personal details and application information including relevant documents to HANUMA VARAHI ESTATES.

You request and authorize HANUMA VARAHI ESTATES to make available such information to the applicable Advertiser/seller(s). You provide consent for your data to be provided to such Advertisers/service providers who may further contact you over phone/email/WhatsApp etc.

Important Notice:

Our privacy policy does not govern the use of your data by third parties once it is shared.

  • By using HANUMA VARAHI ESTATES, you agree that HANUMA VARAHI ESTATES is not responsible for the content of the Advertiser/seller's/broker's/builder's application form, messages, screener questions, testing assessments, required documents, or their format or method of delivery.
  • You consent to your application, documents and any responses being processed and analysed by HANUMA VARAHI ESTATES according to these terms of use and privacy policy. HANUMA VARAHI ESTATES shall store and process such information regardless of whether a Real Estate that had been advertised continues to remain available or not.
  • HANUMA VARAHI ESTATES may use your application materials (including public profile) to determine whether you may be interested in a Real Estate Listing, and may reach out to you by way of calls/SMS/Emails etc. about such listings or other similar properties (even though you may have registered with National Preference Register).

Public Information Warning:

Information you post in public areas of HANUMA VARAHI ESTATES sites or applications or make visible in your profile may be accessed, used, and stored by others around the world, including those in countries that might not have legislation guaranteeing adequate protection of personal information.

While HANUMA VARAHI ESTATES takes measures to safeguard your information from unauthorized access or inappropriate use, we do not control third parties and we are not responsible for their use of information you give to us.

Accordingly, you should not post sensitive information or any other information you would not want made public.

It shall be the sole responsibility of the user to ensure that it uses the 'Opt-out' options as it deems fit to debar/refuse access of the data fed by it, to dealers. Company shall not be responsible for such insertions/data being accessed by its subscribers or users whose access has not been specifically blocked/debarred by the user while using the privacy settings.

In order to use HANUMA VARAHI ESTATES you may sign in using your Facebook/Google login. If you do so, you authorize us to access and use certain Facebook/Google account information, including but not limited to your public profile and posts. For more details, please visit our privacy policy.

Terms for Dealers/Builders/Banks/Payment Gateways

Section 17

Specific terms for commercial entities:

  • 1.You will comply with all applicable Data Protection Laws in relation to the Processing of personal data; and not process personal data which is irrelevant, in an unlawful manner and excessive with regard to agreed purposes as defined in the privacy policy and these terms and conditions.
  • 2.You shall implement adequate technical and organizational controls to protect the shared personal data obtained from HANUMA VARAHI ESTATES against unauthorized or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure.
  • 3.You agree to provide reasonable assistance as is necessary to facilitate the handling of any Data Security Breach in an expeditious and compliant manner.
  • 4.You agree that the responsibility for complying with a request of an individual with respect to his/her personal data lies with the Party which holds/processes the personal data collected/shared.
  • 5.You warrant and represent that the institution shall not disclose or transfer Personal Data obtained from HANUMA VARAHI ESTATES to any sub-processors without ensuring adequate and equivalent safeguards to the Personal Data.
  • 6.You shall retain or process shared personal data for no longer than is necessary to carry out the agreed purposes.

Arbitration

Section 18

If any dispute arises between a user/users and Company arising out of use of the website or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these terms and conditions, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party.

Arbitration Terms:

  • Decision of the Arbitrator shall be final and binding on both parties to the dispute
  • The Arbitration & Conciliation Act, 1996 shall govern the arbitration proceedings

Severability of Provisions

Section 19

This Agreement between you and Company governs your use of HANUMA VARAHI ESTATES.

If any provision of these HANUMA VARAHI ESTATES terms and conditions or part thereof is inconsistent with or is held to be invalid/void by or under any law, rule, order or regulation of any Government or by the final adjudication of any court, such inconsistency or invalidity shall not affect the enforceability of any other provision of the terms and conditions.

Waiver

Section 20

The failure of Company to exercise or enforce any right or provision of the terms and conditions of use shall not constitute a waiver of its right to enforce such right or provision subsequently.

Governing Law

Section 21

Applicable Law:

By accessing HANUMA VARAHI ESTATES you agree that the laws prevailing in India shall be the governing laws in all matters relating to HANUMA VARAHI ESTATES as well as these terms and conditions.

Jurisdiction

Section 22

Exclusive Jurisdiction:

Courts at Nellore, India alone shall have the exclusive jurisdiction in all matters relating to HANUMA VARAHI ESTATES and these terms and conditions, irrespective of the territory and jurisdiction of your access to HANUMA VARAHI ESTATES.

Content Monitoring & Enforcement

Section 23

Company does not routinely monitor your postings to the website but reserves the right to do so.

However, if Company becomes aware of an inappropriate use of HANUMA VARAHI ESTATES or any of its Services, Company will respond in any way that, in its sole discretion, Company deems appropriate.

Law Enforcement Cooperation:

You acknowledge that Company will have the right to report to law enforcement authorities any actions that may be considered illegal, as well as any information it receives of such illegal conduct.

When requested, Company will co-operate fully with law enforcement agencies in any investigation of alleged illegal activity on the Internet.

Company reserves all other rights.
